Through the Canadian Spousal Sponsorship program, Canada offers a clear and direct pathway to permanent residency for spouses and partners. As a Canadian citizen or permanent resident, you can sponsor your spouse, common-law partner, or conjugal partner, along with their dependent children, for permanent residency.
Sponsorship’s eligibility criteria
To become a sponsor, follow these steps:
- The candidate must be at least eighteen years old.
- Either be enrolled under the Canadian Indian Act or be a permanent resident or citizen of Canada.
- Be financially capable of supporting your partner.
- Not be receiving social assistance (except for disability reasons).
If you are a permanent resident, you have to live in Canada during your application. The partner becomes a permanent resident; Canadian nationals residing overseas must show intention of returning. Some disqualifications apply, including a criminal background, exceptional financial responsibilities, or recent sponsorship history.
Unique Issues for Quebec Residents
Criteria and sponsors must apply through Immigration, Refugees, and Citizenship Canada (IRCC) as well as the Ministère de l’Immigration, de la Francisation, and de l’Intégration (MIFI). The sponsor must sign an undertaking agreement and undergo an income assessment. Sponsorship applications will be accepted at 13,000 between June 26, 2024, and June 25, 2026.
Whoever You Could Sponsor
Your legally married spouse, common-law partner (cohabiting for at least one year), or conjugal partner—who has been in a committed relationship with you but confronts legal or social constraints—may be sponsored by you. All candidates have to be at least eighteen years old and admitted to Canada.
Sponsorship Categories
There are two main categories for spousal sponsorship:
1- Inland Canadian Spousal Sponsorship (Spouse or Common-Law Partner in Canada Class)
- The sponsored partner must be in Canada.
- Open work permits are available during the application process.
- Applicants must remain in Canada until a decision is made.
- Processing time: 28 months
2- Outland Canadian Spousal Sponsorship (Family Class)
- The sponsored partner can be inside or outside Canada.
- Conjugal partners must apply under this category.
- This policy allows travel in and out of Canada while awaiting approval.
- Right to appeal if the application is refused.
- Processing time: 10 months.
Legal and financial commitments
Sponsors must sign an undertaking agreement committing to financially support their partner, ensuring they do not require government assistance. This commitment remains binding even if circumstances change, such as separation or financial hardship.
Spousal sponsorship is a structured but rewarding process, allowing couples to build a life together in Canada. Understanding the requirements and obligations ensures a smoother application experience.
