Is a humanitarian and compassionate (H&C) application the right route to permanent residence in Canada? It may be considered for certain foreign nationals living in Canada who need an exception from ordinary immigration requirements and have sufficiently compelling circumstances. It is an exceptional, discretionary request under A25(1), not a standard alternative to family sponsorship, Express Entry or a refugee-protection claim.
If you have a refusal, a removal order, children affected by removal, or an unresolved refugee claim, the order of decisions matters. A pending H&C application does not itself stop a removal. Book an H&C eligibility and evidence consultation → before relying on an application to protect your status.

A foreign national currently living in Canada seeking a specified exemption?
Another PR class, ongoing refugee claim, prior H&C or refugee-claim bar?
Compelling hardship, establishment, family circumstances and children’s interests?
Any removal order or immigration-status issue needing separate attention now?
Who may qualify to request H&C consideration?
IRCC’s official IMM 5291 instruction guide describes an in-Canada process for foreign nationals who need an exemption from an IRPA or IRPR requirement and whose circumstances may justify exceptional consideration. Applicants should identify the exact exemption requested and provide sufficient, individualized supporting reasons. A prolonged stay or difficulty leaving Canada, alone, does not automatically establish an exceptional case.
Compare normal pathways first. If you qualify for a spouse/common-law sponsorship or another suitable PR class, IRCC directs applicants to the appropriate class rather than using H&C as a substitute. For sponsorship-related eligibility see MAK’s family sponsorship information.
When an H&C application may not be available
The restrictions are consequential. IRCC states that the H&C application route is generally unavailable to people who are already Canadian citizens or permanent residents, have another H&C application awaiting decision, or have an outstanding refugee claim. A rejected, abandoned or withdrawn refugee claim can trigger a 12-month restriction, with specific exceptions, including certain risks to a child directly affected or medical-care-related conditions as explained in the current guide. Other bars apply in designated-foreign-national situations.
Do not assume a general exception applies to your facts. If a refugee claim, appeal or removal matter is involved, obtain a case-specific eligibility assessment of dates, decisions and any legal exceptions before submitting. Protection claims concerning persecution or torture follow different legal processes.
What evidence can make an H&C request credible?
IRCC evaluates the person’s actual circumstances. Factors can include establishment in Canada, family and community ties, circumstances affecting children, relevant health needs, family violence, separation from close relatives, and difficulties in a country of origin that are not simply a substitute for refugee protection. There is no automatic point system or list guaranteeing approval.
| Relevant issue | Examples of individualized evidence |
|---|---|
| Establishment and ties | Genuine work or study history, residence records, community participation, social ties and reliable supporting letters |
| Best interests of a child | Specific education, developmental, caregiving, medical and family-impact records; evidence of actual effects, not generic claims |
| Hardship and country factors | Credible facts about anticipated difficulty, relevant conditions, individualized records and explanations of available alternatives |
| Family or health circumstances | Consent-appropriate records of caregiving, significant health needs, separation effects or family violence when relevant |
Children’s best interests must be considered where directly affected, but they do not automatically outweigh every other factor. IRCC expects specific information about each affected child and how the decision may affect them.
Important distinction: an H&C application does not stop removal
IRCC’s guide expressly explains that filing an H&C application while under a removal order does not delay the required removal. It should not be presented as automatically restoring temporary status, providing work authorization, or suspending immigration enforcement. Someone facing an imminent deadline should obtain appropriate professional advice about the actual legal options separately.
Filing process and supporting documents
- Confirm the correct class and requested exemptions. Check restrictions, other PR routes and any refugee-proceeding history.
- Build a personal factual chronology. Record dates of Canadian residence, employment, family connections, immigration actions and significant events.
- Collect genuine corroboration. Use IRCC’s evidence and form checklist. Do not fabricate letters, hardship narratives or child-impact documents.
- Complete the required digital and PDF forms. IRCC’s current guide directs most applicants to the Permanent Residence Online Application Portal and its current document checklist.
- Maintain accurate information. Advise IRCC of material family or situation changes as required while the application is considered.
The published checklist and forms can change. Follow the current IRCC H&C application package rather than old copied forms, fees or timelines.
Frequently asked questions
Is H&C a guaranteed pathway after a work or study permit refusal?
No. Refusal alone does not establish compelling humanitarian circumstances or an exemption. The right approach depends on the refusal, your current status, other classes and the evidence.
Can I file H&C while a refugee claim is still pending?
IRCC lists an outstanding refugee claim among circumstances in which this H&C application route may not be used. Refugee-claim bars and any exceptions are case-specific and should be checked before filing.
Does having a child born in Canada guarantee H&C approval?
No. The best interests of each directly affected child are important, but the decision is individualized and no single circumstance guarantees approval.
Does an H&C application automatically keep me in Canada?
No. IRCC says an application does not delay removal under an existing removal order. Do not treat filing a package as a separate grant of lawful temporary status or a work permit.
